Terms and Conditions for Gardeners South Wimbledon Services

These Terms and Conditions set out the basis on which Gardeners South Wimbledon provides gardening and related services to residential and commercial customers. By placing a booking, accepting a quotation, or allowing our gardeners to start work at your property, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the individual, company, or organisation that requests or receives services from Gardeners South Wimbledon.

Services means gardening and related services provided by Gardeners South Wimbledon, including but not limited to lawn care, hedge trimming, planting, garden clearance, maintenance, and similar work.

Site means the garden, outdoor space, or other premises where the Services are to be provided.

Agreement means the contract between the Customer and Gardeners South Wimbledon incorporating these Terms and Conditions, any written quotation, and any specific written variations agreed by both parties.

2. Scope of Services

Gardeners South Wimbledon provides general gardening, maintenance, and related outdoor services within our standard service area in and around South Wimbledon. Any description of services in marketing materials is illustrative only. The exact scope of work will be confirmed in a quotation, booking confirmation, or work specification agreed with the Customer.

The Customer is responsible for ensuring that the description of the Services and the Site details are accurate and complete. If, on arrival, we find that the work required is significantly different from what was described or quoted, we may adjust the price, change the time required, or refuse the job if agreement cannot be reached.

3. Booking Process

Bookings may be made by contacting Gardeners South Wimbledon through our accepted communication channels. When making a booking, the Customer must provide full and accurate details of the required Services, the Site address, access arrangements, and any relevant hazards or restrictions.

A booking is not confirmed until we have provided written confirmation or have explicitly accepted the booking details. We reserve the right to decline any booking request at our sole discretion.

For certain Services, particularly larger projects or ongoing maintenance contracts, we may require an on-site assessment before confirming the quotation and booking. Any timeframes provided before such assessment are estimates only and subject to change.

4. Quotations and Pricing

Quotations are usually based on the information supplied by the Customer and, where applicable, any Site visit. Quotations may be provided as a fixed price for defined work or as an hourly or daily rate with an estimate of the time required.

Unless otherwise stated, quotations are valid for a limited period from the date of issue. We may withdraw or amend any quotation that has expired or where the information on which it was based proves to be incorrect or incomplete.

Additional work requested by the Customer that is not included in the original quotation will be chargeable at our standard rates or as otherwise agreed in writing. Any variation in the scope of Services must be agreed before the additional work is undertaken.

5. Access and Customer Obligations

The Customer must ensure that our gardeners have safe and adequate access to the Site for the duration of the visit, including any required parking or access through communal areas. Any parking charges, congestion charges, or similar costs reasonably incurred will be added to the Customer's invoice unless otherwise agreed.

The Customer must inform us prior to the booking of any risks or hazards at the Site, including but not limited to uneven ground, unsecured pets, fragile surfaces, or underground services such as cables, irrigation pipes, and drainage systems that could be affected by the work.

The Customer is responsible for securing valuables and removing any items that may obstruct the work. Gardeners South Wimbledon will not be liable for damage to items left in work areas where the Customer has not taken reasonable steps to move or protect them.

6. Materials, Equipment, and Tools

Unless agreed otherwise, Gardeners South Wimbledon will supply the tools, machinery, and standard equipment necessary to carry out the Services. Where specialist equipment or materials are required, this may incur additional charges that will be explained to the Customer in advance where reasonably possible.

Where the Customer provides materials or equipment, they are responsible for ensuring that such items are suitable and safe for use. We accept no liability for defects or failures arising from Customer-supplied materials or equipment.

7. Payments and Invoicing

Payment terms will be specified at the time of booking or within the quotation. Unless otherwise agreed, payment is due immediately upon completion of the Services or upon receipt of the invoice, whichever is earlier.

We may require a deposit or part-payment in advance for larger projects, one-off clearance works, or where significant materials must be purchased. Any deposit requirements will be communicated before the booking is confirmed.

Payment methods will be specified in our booking confirmation or invoice. The Customer is responsible for ensuring that full payment is made within the stated timeframe. If payment is not received by the due date, we reserve the right to charge interest on overdue amounts at a reasonable commercial rate and to recover any reasonable costs incurred in pursuing late payment.

8. Cancellations and Rescheduling

The Customer may cancel or reschedule a booking by giving reasonable notice through our accepted communication channels. Specific notice periods may be detailed in our booking confirmation. If the Customer cancels a booking without sufficient notice, we reserve the right to charge a cancellation fee to cover our reasonable costs and lost time.

If our gardeners attend the Site at the agreed time and are unable to carry out the work due to lack of access, unsafe conditions, or other issues within the Customer's control, we may charge a call-out fee or the minimum service charge for that booking.

Gardeners South Wimbledon may need to cancel or reschedule a booking due to events beyond our reasonable control, such as severe weather, staff illness, or equipment failure. In such cases, we will aim to provide as much notice as possible and to arrange an alternative appointment. We will not be liable for any loss arising from such cancellations or delays, but any deposits paid for the affected booking will either be applied to the rescheduled date or refunded if no alternative can be agreed.

9. Weather and Site Conditions

Certain gardening tasks cannot be carried out safely or effectively in adverse weather conditions, such as heavy rain, snow, high winds, or extreme temperatures. We reserve the right to postpone or adapt the Services if the weather or Site conditions make the work unsafe or inappropriate.

If a visit is cut short or altered due to weather or Site conditions beyond our control, we will discuss alternative arrangements with the Customer. Charges may be adjusted depending on the work completed and any return visit required.

10. Waste Removal and Environmental Regulations

Garden waste and other materials arising from the Services will be handled in accordance with applicable environmental and waste regulations. By default, garden waste will be left bagged or neatly stacked at the Site for the Customer to dispose of, unless the quotation expressly includes waste removal.

Where waste removal is requested and agreed, additional charges will apply to cover transport, tipping fees, and handling in line with relevant regulations. Hazardous or controlled waste, including but not limited to contaminated soil, certain liquids, or non-garden waste, may not be accepted or may incur additional specialist disposal costs.

The Customer must not request or allow our gardeners to dispose of waste in a manner that breaches any legal or regulatory requirements. Gardeners South Wimbledon is committed to lawful and responsible waste management and may refuse any waste removal that cannot be conducted in compliance with such requirements.

11. Liability and Insurance

Gardeners South Wimbledon will provide the Services with reasonable care and skill, using competent personnel and appropriate equipment. We hold insurance appropriate for the nature of our services, details of which can be made available upon request.

Our liability to the Customer for any loss or damage arising from the Services is limited to the amount paid by the Customer for the specific booking during which the loss or damage occurred, except where such limitation is not permitted by law.

We will not be liable for any indirect or consequential loss, loss of enjoyment, loss of profit, loss of opportunity, or similar losses arising from the provision or non-provision of the Services. We are also not responsible for pre-existing defects at the Site, inherent weaknesses in plants, trees, structures or surfaces, or damage arising from circumstances outside our reasonable control.

Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot legally be limited or excluded.

12. Damage to Property and Plants

While every reasonable effort is made to protect the Customer's property, some work may involve risk to existing plants, lawns, fences, paths, or other garden features. The Customer acknowledges that certain plants may not survive pruning, transplantation, or other horticultural operations, even when carried out with care.

If accidental damage to property occurs as a direct result of our negligence, the Customer must notify us as soon as reasonably practicable, and in any event within a reasonable period after the incident. We reserve the right to inspect the alleged damage and, where appropriate, repair or replace the affected item or offer fair compensation, subject to the liability limitations set out in these Terms and Conditions.

13. Customer Satisfaction and Complaints

If the Customer is dissatisfied with any aspect of the Services, they should contact Gardeners South Wimbledon as soon as possible, ideally within a short period after completion of the work, so that we have an opportunity to review and, where appropriate, rectify the issue.

We will investigate complaints in good faith and may request photographs, descriptions, or access to the Site to understand the concern. Where a complaint relates to the quality of work, we may, at our discretion, return to the Site to carry out reasonable remedial work. This does not affect any statutory rights the Customer may have.

14. Health and Safety

Gardeners South Wimbledon places high importance on health and safety. Our gardeners will follow reasonable safety procedures while on Site. The Customer must not request or insist on work being carried out in a manner that is unsafe, breaches health and safety rules, or involves the use of equipment or methods that are not appropriate for the task.

We reserve the right to refuse or suspend work where we consider there to be an unacceptable risk to health or safety, including but not limited to unsafe structures, aggressive animals, or hazardous substances at the Site.

15. Termination of Ongoing Services

Where the Services are provided on a regular or ongoing basis, either party may terminate the Agreement by giving the notice specified in the maintenance or service arrangement, or, if no specific period is stated, by giving reasonable written notice.

We may terminate or suspend Services immediately if the Customer breaches these Terms and Conditions, fails to pay any sums due, behaves in an abusive or threatening manner towards our staff, or causes conditions at the Site to become unsafe.

16. Variations to Terms

Gardeners South Wimbledon may update or amend these Terms and Conditions from time to time. The version in force at the time of your booking will apply to that specific Agreement. Any significant changes to key terms may be communicated to regular or contract customers where practicable.

No variation to these Terms and Conditions will be binding unless it is agreed in writing by Gardeners South Wimbledon and the Customer.

17. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or with the Services, shall be governed by and construed in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or relating to these Terms and Conditions, the Agreement, or the Services provided by Gardeners South Wimbledon.

18. Severability

If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable. If such modification is not possible, the relevant provision shall be deemed deleted. Any such invalidity or unenforceability shall not affect the remaining provisions, which shall continue in full force and effect.

19. Entire Agreement

These Terms and Conditions, together with any written quotation or service schedule provided by Gardeners South Wimbledon, constitute the entire agreement between the parties and supersede any prior discussions, correspondence, or understandings relating to the Services. The Customer acknowledges that they have not relied on any statement, promise, or representation that is not set out in the Agreement.

By confirming a booking or allowing our gardeners to commence work at the Site, the Customer confirms that they have read, understood, and agree to these Terms and Conditions.
